If you've enabled our Data Protection features, you will see a data privacy section is included on the checkout form, which attendees must accept to continue to payment. This should be used only for items which are mandatory, like your terms and conditions.

For optional items, like joining the mailing list, you can use our Opt-ins feature. Once enabled, you'll find it in the sidebar menu under Private Beta Features.

Create your opt-in, give it a name and and optional description. Be sure to also attach it to the relevant tickets otherwise it won't be displayed.

Opt-ins are shown in a new section of the checkout called Your preferences:
